CARE GIVER IMMIGRATION CANADA

The Live-In Caregiver Program (LCP) in Canada is for foreign nationals who want to work as a caretaker/nanny in the home of a Canadian citizen for their children or someone with disabilities. This would open up a straight route to permanent residency. Foreign nationals can apply for permanent residence after just two years of working under the LCP work permit.

Eligibility

Applicants for the live-in caregiver program must meet the following requirements:

● Have a valid work permit, or have applied to have your work permit extended, or have applied to have your worker status restored in Canada.
● Have prior job experience as a Home Child Care Provider or a Home Support Worker in Canada.
● Have worked full-time for at least one year since November 30, 2014, which can be cumulative rather than continuous but cannot include work done while a student.
● Have been employed in a position that fulfills the responsibilities indicated in your NOC code.
● In all four areas of reading, writing, speaking, and listening, have demonstrated language skills equivalent to Canadian Languages Benchmark (CLB) 5 or NLCL (French language) 5.
● Have a minimum of a Canadian High School Diploma or an equivalent international diploma, certificate, or credential.

How To Apply

New applications for the Live-In Caregiver Program are currently closed.If you want to work as a caregiver in Canada and don’t already have an LCP work permit, you’ll need to apply for a standard work permit.

Only if you meet the following criteria can you employ a caregiver through this program:

● Identified a caregiver who already has a Live-in Caregiver Program work visa and is seeking a new job, and
● A Labour Market Impact Assessment (LMIA) has been approved, indicating that the carer has accepted to live in your house

How to apply for permanent residency as a live-in caregiver

If you meet the following criteria, you may be able to apply for permanent residence in Canada under the Live-in Caregiver Program:

● Have worked in Canada for at least two years in a permitted full-time live-in job, or

CANADA ATLANTIC IMMIGRATION PILOT PROGRAM (AIPP)

The Atlantic Immigration Pilot Initiative is an immigration program that permits employers in Canada’s Atlantic provinces to hire immigrants.
This program also allows you to apply for permanent residence.

AIPP has two programs for skilled workers, both of which were introduced in 2017:

Atlantic High-Skilled Program: The high-skilled worker must have work experience at National Occupations Classification (NOC) skill type 0, A, or B.

Atlantic Intermediate-Skilled Program: Intermediate-skilled workers are required to possess work experience at the NOC skill level C, whether gained within or outside of Canada.

It also offers a program for international students:

Atlantic International Graduate Program: International students with a diploma or other comparable credentials from an Atlantic public educational institution are eligible to apply for the Atlantic International Graduate Program.
Eligibility

You must be a recent graduate of a publicly financed institute in Atlantic Canada or a skilled worker who meets the program’s qualifications to be eligible for the Atlantic Immigration Pilot Program.

You must also show the following documentation:

● Proficiency in languages
● Education
● Experience in the workplace
● Stability of finances

After receiving a job offer, you must:

● Request a copy of the employer’s Designation Confirmation, or
● Tell them about the Atlantic Immigration Pilot and encourage them to apply if they haven’t already.

Required Documentation

The AIPP requires a number of documents. The documents differ depending on the programs selected. For all, only a few primary documents are required.

The following are the basic documents you will require:

● Test results for language skills (TEF or IELTS)

● Educational Credential Assessment (ECA)

Application Process

Step 1: The employer connects the candidate with a settlement service provider. The said provider will now undertake a needs assessment service in order to determine the candidate’s and family’s settlement plan.

Step 2: The chosen settlement plan is forwarded to both the employer and the candidate.

Step 3: The employer fills out the endorsement application and finds a program that matches the employee’s job experience. The province receives the job offer and settlement plan.

Step 4 : The IRCC receives a completed permanent residency application from the candidate. It is accompanied by the appropriate documentation and an endorsement letter.

Step 5: The application has been filed, and if granted, the candidate and his or her family will be able to relocate to Atlantic Canada.

FAMILY SPONSORSHIP CANADA

You can sponsor specific relatives to come to Canada if you are a Canadian citizen or permanent resident who is at least 18 years old. If your relatives become permanent residents, they will be able to live, study, and work in Canada.

● Sentenced to

● Sexual offenses,
● Crimes of violence,

Sponsor your parents and grandparents

Under the Family Class, if you are a Canadian citizen or permanent resident, you may be able to sponsor your parent or grandparent to become a permanent residence (FC). If you sponsor your parents or grandparents to become a permanent resident of Canada, you must make every reasonable effort to provide your own and your parents’ or grandparent’s basic necessities.

Permanent residency applicants must pass medical, criminal, and background examinations. A person having a criminal record may be denied entry to Canada. People who represent a security threat to Canada are also barred from entering the country. A certificate from police authorities in the applicant’s native country may be required. The application packet explains the medical, criminal, and background checks.

A grandparent or parent can be sponsored if

● You are a Canadian citizen or permanent resident.
● You are at least 18 years old.
● For the previous three years, you have met the Government of Canada’s income requirement.
● You must be a Canadian citizen.
● Depending on their age and relationship to you, you must commit to giving financial support for the relative and any other qualified relatives accompanying them for a period of three to 10 years. This time period begins on the day they become a permanent resident of the United States.

Sponsoring your parent or grandparent may not be possible if you

● You have previously failed to offer the financial support you pledged to while signing a sponsorship agreement to sponsor another relative.
● Defaulted on a court-ordered support order, such as child support or alimony
● Received financial support from the government for reasons other than infirmity
● Were convicted of a violent crime, a crime against a family member, or a sexual offense—depending on the circumstances, such as the nature of the crime, how long ago it occurred, and whether a record suspension (previously known as “pardons” in Canada) was granted.
● Late or missed payments on an immigration loan resulted in default.
● Are imprisoned or
● Have filed for bankruptcy and have not yet been freed.

Sponsor other eligible family members

You may be able to sponsor certain relatives to immigrate under the Family Class if you are a Canadian citizen or permanent resident who is at least 18 years old.

Some relatives may be qualified to become permanent residents of Canada.

Medical, criminal, and background investigations are required for your relatives. If they have a criminal past or pose a security threat to Canada, they may be denied entry. They may need to obtain a police certificate from their own country’s police. Medical, criminal, and background investigations are all explained in the application packet.

You can sponsor your eligible relative if

● You are a Canadian citizen or long-term resident.
● You’ve reached the age of eighteen.
● You meet the Government of Canada’s income threshold
● You’ve got to be from Canada, right?
● Depending on their age and relationship to you, you must commit to giving financial support for the relative and any other qualified relatives accompanying them for up to 10 years. This period starts when they become a permanent resident.

Sponsoring a relative may not be possible if you:

● Previously sponsored another relative and failed to adhere to the sponsorship agreement’s requirements,
● Owe alimony or child support but have fallen behind in payments,
● Received government financial assistance for reasons other than disability,
● Depending on the facts of the case, they were convicted of a violent crime, an offense against a relative, or a sexual offense.
● Not repaying an immigration debt, making late or missing payments,
● Have been imprisoned, or
● Have filed for bankruptcy and have not yet been freed.

Other factors that aren’t on this list may prevent you from sponsoring a relative.

CANADA TEMPORARY RESIDENT VISA

A visitor is a foreign national who wishes to visit Canada for a limited time (such as for work, study or visit).

Except for nationals of visa-exempt nations, all visitors must apply for and acquire a visa before entering Canada through its borders or airports. When arriving at the Canadian border or airport, all travellers who are obliged to get a visa must have it with them.

There are two steps to applying for a visitor visa in Canada:

The First Step

The foreign national must first apply for a visit visa at the Canadian consulate in the country where they are lawfully present. The applicant may be required to attend an interview during which the visa officer will verify the applicant’s reasons for visiting Canada, his ability or willingness to leave Canada within the visa validity period, his social and economic ties to his home country, and his overall admissibility, including medical and criminal records.

The Second Step

The applicant may enter Canada once a visit visa has been issued.
An immigration official will question the applicant at the port of entry to ensure admissibility.

A TRV can be used for numerous purposes. Visas can be obtained up to six months before the intended travel date. The maximum validity period for multiple entry visitor visas is ten years or one month before the passport/re-entry visa expires, whichever comes first. A person requesting entrance as a visitor will usually be granted access for a term of six months by Border Services personnel. The entry is valid for six months if no entry stamp is provided by Canadian border officers at the moment of entry.

Basic Eligibility

To apply for a visa to visit Canada, you must first:
● Have a valid passport or travel document
● To be medically acceptable
● Convince an immigration officer that you have socioeconomic ties to your home country, such as a job, a home, financial assets, or family, that will assure your return.
● You must persuade an immigration officer that you will leave Canada at the conclusion of your permitted stay.
● Ensure that you have sufficient finances to cover your stay.


You could also require:

● A letter of invitation from a Canadian resident
● A bank statement demonstrating sufficient funds
● If you say you’re coming as a tourist, you’ll get a hotel reservation.

STUDENT VISA CANADA

Each year, Canada issues study permits to over 140,000 students from all around the world.
You must apply for a study permit in order to study in Canada. A study permit allows you to study in Canada for the duration of a certain course or program at an approved institute. If the student is a citizen of a nation that requires Temporary Resident Visas for admission into Canada, a Temporary Resident Visa will also be required.

Why Study In Canada?

● Working in Canada as a student is feasible with an off-campus work permit for a maximum of 20 hours per week.
● Foreign students’ spouses or common-law partners are eligible for an open work permit for the same term as the study permit.
● A foreign student may apply for a work permit through the Post-Graduation Work Permit Program after graduation. The work permit may be issued for the duration of the study program, up to a maximum of three years, under this program.
● After earning a Master’s degree from an Ontario publicly supported university, you can apply for permanent residency in Canada under Ontario’s PNP Class.

Eligibility

● You must have received acceptance from a Canadian school, college, university, or other educational institution.
● You must demonstrate that you have the funds to cover your tuition fees, living expenses for yourself and any family members accompanying you to Canada, and return transportation for yourself and any accompanying family members.
● You must be a law-abiding citizen with no criminal record who poses no threat to Canada’s security. It’s possible that you’ll be asked to provide a police certificate.
● You must be in good health and willing to undergo any necessary medical tests.
● You must convince an immigration officer that you will leave Canada when your visa expires.

Off-campus employment

● Full-time students in a designated learning institution pursuing an academic, professional, or vocational training program will be:
● Without a work permit, be able to work off campus;
● Allowed to work up to 20 hours per week off campus during a regular academic session and full time during regularly arranged breaks; and
● Instead of waiting six months, you’ll be ready to work off campus right away.

Applying For a Student Visa Online

You must submit your student visa application using the CIC’s official website. You have up to three months to apply before your planned trip to Canada. Remember that your application date is the day on which you pay your application fee.

REFUGEE

The Canadian refugee protection program is divided into two categories:

A program for refugees and humanitarians seeking shelter outside Canada
Asylum program for those claiming refugee protection within Canada


People seeking protection from outside of Canada

In Canada, resettlement is possible for two groups of people.

1) Convention Refugee Abroad Class

This class may apply to you if:

● You live outside your home country; and
● Cannot return to the country as a result of:

● Race,
● Religion,
● Political opinion,
● Nationality, or
● A member of a particular social group, such as women or people who share a specific sexual orientation.

Additionally, you must be:

● Be referred to by the UN High Commissioner for Refugees (UNHCR), another organization, or sponsored by a private group as well as
● Be eligible for government-sponsored refugee status or private sponsorship, or be able to provide for yourself and any dependents upon arrival in Canada.

2) Country of Asylum Class

You may be in this class if:

● Are outside your home country or the country where you live normally and have been personally affected by war or civil conflict, or have suffered large-scale violations of human rights.

Additionally, you must be:

● Sponsored by the United Nations High Commissioner for Refugees (UNHCR) or another referral agency, or sponsored by a private sponsoring organization.
● Obtain private sponsorship, or have the means to support you and any dependents once you arrive in Canada.

It will be necessary for you to pass a medical exam and a security and criminal check.

People making refugee claims from within Canada

Canadians who fear persecution and are unwilling or unable to return to their countries of origin can apply for refugee status in Canada.

An Immigration and Refugee Board of Canada (IRB) representative will determine if you qualify for referral to IRB, an independent administrative tribunal that makes decisions on immigration and refugee matters. Refugees and persons in need of protection are adjudicated by the IRB.

Refugees under the Convention
Convention refugees are those who are not in their home country or that they normally live in, and who are not willing to return to the country, due to a well-founded fear of persecution:

○ Race,
○ Religion,
○ Political opinion,
○ Nationality, or
○ A member of a particular social group, such as women or people who share a specific sexual orientation.

Who is a person in need of protection?

A person who needs protection is one whose removal from Canada to their country of origin or their country of normal residence would cause them to face:

● A danger of torture;
● A risk to their life; or
● A risk of cruel and unusual treatment or punishment.

The Canadian government does not provide refugee status to all people. Refugee claims may not be referred to the IRB if:

● The Convention refugee status has been recognized by another country, to which you can return;
● As a protected person in Canada, you already have protection;
● You crossed the border from Canada to the United States;
● If you have engaged in criminal activity or violated human rights, you cannot enter Canada;
● The IRB deemed that your previous refugee claim was ineligible to be referred;
● If you have made a previous refugee claim that was rejected by the IRB; or

Moreover, people to whom a removal order has been issued are not eligible to apply for asylum.

Agreement on Safe Third Countries
According to an agreement between Canada and the United States, refugees can apply for asylum in the first safe country they reach. It is therefore not possible to claim refugee status in Canada if you arrive via land from the United States. In certain situations, this rule does not apply (for example, if you have family living in Canada).

PROTECTED PERSON

The Immigration and Refugee Board (IRB) and the Citizenship and Immigration (CIC) departments both exist in Canada. Both have the authority to determine whether or not an application is a Protected Person. If the IRB determines that you require protection, or if you are a “Convention Refugee,” you are a Protected Person. If CIC has accepted your Pre-Removal Risk Assessment, you are also a Protected Person. Based on the application conditions, a Protected Person can apply for permanent residency.

Determining A Protected Person

An IRB or CIC letter of determination can be requested by a protected person.

They are as follows:

● Foreign nationals who, according to the IRB, require protection;
● The IRB has concluded that foreign nationals are convention refugees.
● Foreign nationals who receive a positive Pre-Removal Risk Assessment (with the exception of those who are covered by section 112(3) of the Act);
● Humanitarian-Protected Persons Abroad; foreign nationals who are members of the Humanitarian-Protected Persons Abroad classes;
● Members of the Convention Refugees Abroad class of foreign nationals.

Eligibility

If the IRB or the IRCC has determined that you are a Protected Person or a Protected Temporary Resident, and you are not:

● A Convention refugee in another nation where you could go and live without fear of persecution for the rest of your life;
● A citizen, national, or permanent resident of a country other than the one you left, where you could travel and live without fear of persecution for the rest of your life;
● A Canadian permanent resident

When To Apply?

Unless you have been designated as a Designated Foreign National, you can apply for permanent residence at any time after being notified by the Immigration and Refugee Board (IRB) or IRCC that you are a Protected Person (DFN).

STUDENT VISA CANADA

Each year, Canada issues study permits to over 140,000 students from all around the world.
You must apply for a study permit in order to study in Canada. A study permit allows you to study in Canada for the duration of a certain course or program at an approved institute. If the student is a citizen of a nation that requires Temporary Resident Visas for admission into Canada, a Temporary Resident Visa will also be required.

Why Study In Canada?

● Working in Canada as a student is feasible with an off-campus work permit for a maximum of 20 hours per week.
● Foreign students’ spouses or common-law partners are eligible for an open work permit for the same term as the study permit.
● A foreign student may apply for a work permit through the Post-Graduation Work Permit Program after graduation. The work permit may be issued for the duration of the study program, up to a maximum of three years, under this program.
● After earning a Master’s degree from an Ontario publicly supported university, you can apply for permanent residency in Canada under Ontario’s PNP Class.
● If you have one year of work experience in a NOC Code 0, A, or B of the National Occupation Classification, you may be eligible to apply for Permanent Residence through Express Entry (Skilled Worker Class or Canadian Experience Class) from within Canada.

Eligibility

● You must have received acceptance from a Canadian school, college, university, or other educational institution.
● You must demonstrate that you have the funds to cover your tuition fees, living expenses for yourself and any family members accompanying you to Canada, and return transportation for yourself and any accompanying family members.
● You must be a law-abiding citizen with no criminal record who poses no threat to Canada’s security. It’s possible that you’ll be asked to provide a police certificate.
● You must be in good health and willing to undergo any necessary medical tests.
● You must convince an immigration officer that you will leave Canada when your visa expires.

Off-campus employment

● Full-time students in a designated learning institution pursuing an academic, professional, or vocational training program will be:
● Without a work permit, be able to work off campus;
● Allowed to work up to 20 hours per week off campus during a regular academic session and full time during regularly arranged breaks; and
● Instead of waiting six months, you’ll be ready to work off campus right away.

Applying For a Student Visa Online

You must submit your student visa application using the CIC’s official website. You have up to three months to apply before your planned trip to Canada. Remember that your application date is the day on which you pay your application fee.

INITIAL CONSULTATION AGREEMENT

This Initial Consultation Agreement is made between Neil Nanda, RCIC (#) And The “Client”

AND WHEREAS the RCIC is a member of the Immigration Consultants of Canada Regulatory Council (ICCRC) (the “Council”), the regulator in Canada for immigration consultants; and bound by the By-laws, Code of Professional Ethics, and Regulations as set forth by the Council; and

IN CONSIDERATION of the mutual covenants contained in this Agreement, the parties agree as follows:

  1. RCIC Responsibilities and Commitments

The RCIC will provide the Client with the following professional services under the terms of this Agreement:

  1. Obtain further information on the Client’s goals;
  2. Obtain information on the Client’s background, qualifications and personal and financial circumstances;
  • Provide advice on the current status of Canadian immigration laws and policies where they relate to the Client’s query;
  1. Review the Client’s information and assess it with the current Canadian laws and policies;
  2. Determine the most appropriate immigration strategy for the Client (if any), and;
  3. Advise the Client on the selected immigration strategy.
  4. Client Responsibilities and Commitments
  5. The Client must provide the RCIC with factual information and documentation as are required to perform the consultation.
  6. The Client understands that information provided must be accurate and honest and he/she must inform the RCIC of all information, even if negative or adverse, which might be relevant to the advice provided by the RCIC in this matter.
  • The Client understands that failure to fully disclose all relevant information to the RCIC will impact the advice given by the RCIC and may void this Agreement, or seriously affect the outcome of the application of the Client or the retention of any status that the Client may obtain.
  1. Limits of Engagement
  2. The services to be provided under this Agreement are limited to a single consultation.
  3. The work done under PAID-30 Minute Consultation Agreement will be limited to thirty (30) minutes only.
  • The work done under PAID-1 Hr Full Assessment and Advise Agreement will be limited to sixty (60) minutes only
  1. The RCIC shall not provide further information or advice to the Client unless the Client and the RCIC have expressly agreed to a continuation of this Agreement beyond the decided initial time period, and for which a fees have been paid. (If 60 min consultation is chosen).
  2. The Client shall pay a consultation fee of CAD$50.00 for the PAID-30 min and CAD $100.00 for the PAID-60 min full assessment and advise consultation.
  3. The Client shall pay an additional consultation fee of CAD$50.00 per extension, or part thereof, beyond the PAID initial consultation period (additional 30 mins)
  • All fees paid are in CAD (Canadian Dollars).
  • The taxes will be charged at 13% as per the provincial tax in Ontario
  1. A fee of 5% will be levied for the transfer fee charged by STRIPE for credit card / debit card payments.
  2. The RCIC does not provide detailed job-hunting advice and career counseling advice.
  3. Fees that have been earned under this agreement are non-refundable.
  • No refunds will be given once the client has booked the appointment.
  • A further available date can be assigned only after the client speaks with the RCIC. The confirmation will be given via email

Other Conditions

  1. The advice provided by the RCIC to the Client is based on the Canadian immigration laws and policies current on the date of the consultation where relevant.
  2. The RCIC is not responsible or accountable for any change in government legislation or policy that may impact the processing of any subsequent application by the Client.
  • The RCIC shall provide consulting services to the Client to the standard of a competent ICCRC member.
  1. The laws in effect in the Province of Ontario, Canada shall govern the terms and conditions of this agreement.
